The Nevada Supreme Court has issued an Order scheduling a public hearing on March 1, 2007, regarding the amendments proposed by the State Bar of Nevada to the rules governing lawyer advertising. Persons interested in participating in the hearing must notify the clerk no later than February 22, 2007.
The court will also accept written comments on the proposed rules until April 6, 2007. Attorneys and members of the public with an interest in the rules governing lawyer advertising are encouraged to participate in the hearing or submit written comments. The petition and proposed rules are available on the Nevada Supreme Court website and on the Nevada State Bar website.
The proposed rule amendments are the culmination of almost two years of work by the Nevada Supreme Court’,s Study Committee on Lawyer Advertising and review by the State Bar’,s Board of Governors. Among other things, the proposed amendments address the standards for communications concerning a lawyer’,s services to ensure that such communications are not false or misleading (RPC 7.1), require that advertisements be filed with the State Bar to facilitate uniform enforcement of the rules in the event that a potential violation is identified in a particular advertisement and provide for peer advisory committees to render safe-harbor advance opinions on the propriety of a proposed advertisement (RPC 7.2), and revoke the provisions regulating and limiting communication of fields of practice other than a specialty (RPC 7.4). The Supreme Court has discretion to adopt, alter, or reject the proposed amendments.
