At its October 3rd meeting, the Nevada Judicial Conduct Code Commission reviewed Canons 2 and 3 of the 2007 ABA Model Code. These Canons address the professional duties of a judge and a judge's personal and extrajudicial activities, respectively. The Commission voted to adopt Canons 2 and 3 and Rules 2.3 through 2.16 and Rules 3.1, 3.2, 3.4 and 3.5, and the related Commentary, with few modifications. The Commission also evaluated the Preamble and Scope sections of the Code and voted to adopt both with a sentence added to the Scope to clarify that an appearance of impropriety cannot form the sole basis for discipline. Drafts of the proposed new Judicial Canons and Rules are posted on the Commission's website. On the Commission's agenda for its next meeting on November 6 and 7 is the evaluation of Rules 3.6 through 3.15 and Canon 4 and Rules 4.1 through 4.4. Canon 4 and its related rules govern the important subject of judges' political and campaign activity. Details of the November meeting agenda are available online. All Commission meetings are open to the public. Judges, lawyers, and interested members of the public are encouraged to submit comments and concerns to the Commission about the current Nevada Code of Judicial Conduct, the 2007 ABA Model Code of Conduct, and the Commission’s proposed new Canons and Rules for Nevada.
