Supreme Court Judicial Conduct Code Commission Releases Final Report

The Nevada Supreme Court’s Judicial Conduct Code Commission has released its final report recommending revisions to the Nevada Code of Judicial Conduct.

Last June, the Nevada Supreme Court established the Commission  to review the 2007 ABA Model Code of Judicial Conduct for possible adoption in Nevada.  The Commission, chaired by A. William Maupin, Chief Justice, Ret., completed its review in March and recommends that the Nevada Supreme Court replace the current Nevada Code of Judicial Conduct with its proposed Revised Code of Judicial Conduct.  Janette M. Bloom served as counsel to the Commission.

“The Commission is composed of some of the finest lawyers, judges and scholars in Nevada,” noted Justice Maupin.  “The Nevada judiciary owes a great debt of gratitude for their commitment to improving the quality of justice in our state.  We must also recognize the dedication and expertise of Janette Bloom, former clerk of the Nevada Supreme Court, for her professionalism and commitment to this project.”

The proposed Revised Nevada Code of Judicial Conduct is the first comprehensive revision of the Nevada Judicial Code since its adoption in 1991. It adopts the new format and numbering of the 2007 ABA Model Code, and, whenever possible, the exact language of the 2007 Model Code.  The Commission concluded that such uniformity with the Model Code and, in turn, the Judicial Codes of other states, provides Nevada with not only a valuable body of law when interpreting Code provisions, but also a Code that has been fully vetted on a national level through the extensive ABA process.

The most significant differences between the proposed Revised Nevada Code and the current Nevada Code of Judicial Conduct are summarized in the Synopsis of Key Changes to the Nevada Code of Judicial Conduct (Appendix B to the Report).  A detailed analysis of each Rule is set out in a comprehensive Comparison of the Revised Nevada Code with the Current Nevada Code and 2007 ABA Model Code (Appendix C to the Report).

The Nevada Supreme Court is expected to hold a public hearing on the Commission’s Final Report and recommendations sometime this summer.
