Commission will Meet Monday to Set Next Step

 

The Commission on Judicial Selection received two applications for appointment to fill the vacancy at the Eighth Judicial District Family Court Department D, Nevada Supreme Court Chief Justice James W. Hardesty announced. 

Applications were accepted until 5 p.m. on Friday, Dec. 18, 2009.

The applicants are:

  • Michele “Shell” Mercer, 47, Las Vegas attorney in private practice.
  • Robert Teuton, 56, a former Clark County Deputy District Attorney.

The Commission will meet at 4 p.m. on Monday to set the next step in the process.  Interviews are expected to be conducted February 11 or 12, 2010 in the Supreme Court’s Las Vegas courtroom on the 17th floor of the Regional Justice Center. 

When there is a mid-term judicial vacancy, the Commission solicits applications and conducts background investigations of all applicants.  The Commission also accepts letters of comment from the public, and conducts an interview of each the candidate.  The Commission then deliberates and submits names of finalists to Governor Jim Gibbons for his appointment.

No time limit exists for the Governor to make his appointment.  However, if an appointment is not made within 30 days following submission of names by the Commission, the Governor may make no other appointments to public office.

The Governor’s appointment will expire in January 2011.  The appointed judge must run in the 2010 election to retain the seat.

 

COMMISSION INVITES PUBLIC COMMENT

The Commission invites public comments about the qualifications of the applicants and requests that such comments be submitted in writing to the Commission Secretary, Ron Titus, Administrative Office of the Courts, Supreme Court Building, 201 South Carson Street, Suite 250, Carson City, Nevada 89701, no later than Friday, January 15, 2010.  An exception to the new rules on openness is that all written comments and letters of reference are kept confidential to ensure the authors can be candid.

The Commission’s comprehensive application process provides commissioners with information about education, law practice, business involvement, community involvement, professional and personal conduct, and health.  While the Commission makes most application information public, certain personal identifiers and health details remain confidential. 

Applications will be posted on the Judicial Selection Commission page of the Supreme Court website (www.nvsupremecourt.us) within a week of the application deadline.

 

THE COMMISSION ON JUDICIAL SELECTION

The Commission on Judicial Selection is composed of seven permanent members – the Supreme Court Chief Justice, three non-attorneys appointed by the Governor and three attorneys appointed by the State Bar of Nevada.  Neither the Governor nor the Bar may appoint more than two permanent members from the same political party, and cannot appoint two members from the same county.

For District Court vacancies, two temporary members are appointed – a non-attorney by the Governor and an attorney by the State Bar – bringing the Commission membership to nine.  The State Bar has appointed Las Vegas attorney Rebecca H. Miller as its temporary member for the current vacancies.  Governor Gibbons named Donna Coleman, a longtime advocate for children’s causes.  She served as a spokesperson for the Child Welfare league of America and the Children’s Advocacy Alliance.  Currently she is president of Donna Coleman & Associates, an executive recruiter for Fortune 500 companies.

The temporary members serve only until the nominations for the vacancy are transmitted to the Governor.  

The regular commission members are:

  • Chief Justice James W. Hardesty, Chair
  • Ruthe Agee, of Spring Creek, Elko County, who works in the orthodontic field, (Governor appointee)
  • Ann Bersi, Ph.D., former deputy district attorney in the Civil Division of the Clark County District Attorney’s Office (State Bar appointee)
  • G. Fred Boyd, small business consultant in Reno (Governor appointee)
  • Scott Freeman, Reno attorney (State Bar appointee)
  • Jeffrey Gilbert, veteran gaming executive (Governor appointee)
  • Thomas L. Stockard, Fallon, Churchill County Deputy District Attorney (State Bar appointee)

The temporary commission members are:

  • Rebecca H. Miller, private attorney in Las Vegas (State Bar appointee)
Donna Coleman, Las Vegas, child advocate and executive recruiter (Governor appointee)
